Terms and Conditions

1. Introductory Provisions

1.1 These terms and conditions govern the rights and obligations between the seller - Miroslav Zeman, Company ID: 19739036, VAT ID: CZ9409045525, with registered office in Rychvald (hereinafter "seller" or "I") - and you as the buyer (hereinafter "buyer" or "customer") in the sale of goods through a website, social networks or other direct contact.

1.2 I am a natural person operating under a trade license, and I am a VAT payer. Most of my offerings include handmade and engraved products, often custom-made according to individual customer wishes.

2. Product Offer and Service Characteristics

2.1 All goods offered through the website or other channels are the result of original authorship and manual processing. Products such as engraved pendants, jewelry, coasters, tags, and other items are often made to measure and according to customer specifications, making them unique.

2.2 Each product may vary slightly in material structure, engraving depth, or color shades – this is a natural part of handmade work and not a product defect.

3. Order and Conclusion of Contract

3.1 Orders can be placed via web form, email, social networks, or direct agreement. By submitting an order, the customer confirms that they have read these terms and conditions and agree to them.

3.2 The purchase contract is concluded at the moment the seller accepts the order. For personalized orders (e.g., name, text, date, image), the buyer is obligated to provide all necessary materials for production to begin.

3.3 The seller reserves the right to refuse an order, especially if it is not technically or timely feasible to fulfill, or if the customer has previously violated their obligations.

4. Price and Payment Terms

4.1 Prices for individual products are listed in Czech Koruna (CZK). I am a VAT payer. The final order price may be determined individually based on the complexity of personalization, scope of work, and materials used.

4.2 Upon order confirmation, the customer will receive an invoice or payment details. Payment is made by bank transfer. For custom orders, advance payment is required. For regular, customized goods, payment on delivery may be possible by arrangement.

4.3 The purchase price is due within 5 working days, unless otherwise agreed by the parties. After receiving payment, the order is put into production.

5. Delivery Conditions

5.1 Delivery time begins upon receipt of payment and all necessary materials for personalization. The usual production time is 3-7 business days; in exceptional cases (e.g., a larger number of items, custom-ordered material, or more complex engraving), the time may be longer – the customer will be informed of this in advance.

5.2 Goods are sent via Zásilkovna, Czech Post, or another carrier as agreed. The customer is obliged to check the shipment upon receipt and, in case of damage, immediately contact both the carrier and me.

Personal collection in Rychvald is also possible by prior arrangement.

6. Withdrawal from the contract

6.1 According to § 1837 lit. d) of the Civil Code, it is not possible to withdraw from a contract for goods that have been modified according to the consumer's wishes or for their person – i.e., for personalized and custom-made products.

6.2 For goods without modifications, the customer has the right to withdraw from the contract within 14 days of receiving the shipment. In this case, it is necessary to inform me of the withdrawal in writing via email at info@klers.cz. The costs of returning the goods are borne by the customer.

6.3 Returned goods must be unused, undamaged, and in their original packaging. After delivery and inspection of the goods, the purchase price will be refunded to your account within 14 days.

7. Complaints and Liability for Defects

7.1 Goods are covered by a 24-month warranty from receipt, unless stated otherwise. For custom-made products, however, the warranty may be limited to material defects – not to the content or appearance of the result according to personalization.

7.2 A complaint can only be made in the case of a manufacturing defect or mechanical damage that occurred during production. A complaint cannot be accepted for:

• normal wear and tear of goods,
  

• improper handling or storage,
  

• minor deviations caused by manual processing.
  

7.3 Complaints must be submitted in writing via email, including a photo of the defect and the order number. Complaints will be processed within 30 days at the latest.

8. Responsibility for provided materials and engraving motifs

8.1 The customer is fully responsible for the content, motifs, texts, graphics, or any other materials provided for engraving.

8.2 The customer hereby confirms that they possess all necessary rights to the provided materials, especially copyright and licensing rights, and that their use does not infringe upon the rights of third parties (e.g., trademarks, licenses, copyrighted works, etc.).

8.3 The operator bears no responsibility for any potential infringement of third-party rights caused by content supplied by the customer.

8.4 All legal responsibility for the content of the engraving rests solely with the customer. The operator reserves the right to refuse to fulfill an order if the motif is clearly illegal or inappropriate.

9. Personal Data Protection

9.1 Your personal data is processed exclusively for the purpose of fulfilling your order and my legal obligations. Detailed information about personal data protection can be found in the separate document Personal Data Protection Policy (GDPR).

9.2 Your data is not provided to third parties, except for carriers and accounting systems, and only to the necessary extent.

10. Final Provisions

10.1 These terms and conditions come into effect on November 1, 2025, and replace all previous versions. I reserve the right to change them, and the new version will always be available on the website.
